论国际战争合法性的价值观基础

摘　　要：国际战争合法性的理念价值基础，是指国际战争合法性具有为国际社会所认同、顺应时代发展的价值观念的支撑与昭引。战争所基于的先进的、时代的、国际社会主流的理念价值是战争合法陛的形成源头和成长内核，汇成人类头顶灿烂的道德星空，指引着走出冲突丛林的方向。但是，理念价值并非一成不变，而是随着社会实践的发展而发展，具有系统性、竞争}生和稳定中的变迁性。全球治理背景下，国家主权原则并未凋谢，但包括人权原则在内的诸多全人类共享理念价值不断生长，正成为战争合法性形成的源泉。当前，对于坚持和平发展。致力于实现“中国梦”、推动构建人类命运共同体的中国而言，在面对战争逼迫而防御自卫及其他武力运用时，为增强合法性，应多措并举厚培理念价值基础。The ideational foundation, as the core element in the formation of the legitimacy of international war, refers to certain values shared by the international society. They merge into a moral starry sky above human beings, showing the direction for people to go out of the Conflict Jungle. The ideational values, however, is not always the same, but develops continuously with the development of social practice, and therefore has features of systematicness, competitiveness and changeability in stability. Under the background of global governance, although the sovereignty principle doesn＇t fade, a great deal of values shared by humanity including human rights principle have been growing and become an important source of the legitimacy of modem international war. Today＇s China, which is committed to peaceful development, realizing the great rejuvenation of the Chinese nation and promoting the building of a community of common destiny for mankind, should take more measures to promote the ideational foundation in order to enhance the legitimacy of defensive use of military power and other uses of force in the face of war pressure.
