摘 要:由于理论和实务对检察办案组织与权限界定原则的关注不足,已有的检察官权力清单与改革目标还有不少差距。分级与分类是制定检察官权力清单的基本路径。从检察官的分级角度,我国应当重新厘定上下级检察机关之间的管辖权下放问题,同时在完善检察官员额制的基础上,根据检察官的职级而非行政级别进行权力分配。从检察权的分类角度,我国应当在对检察权内涵类型化的基础上,明确检察权运行方式多样化的目标,以此形成行政性、司法性和督促性的权力运作模式与机制,并据此优化权力配置。Due to the lack of attention to procuratorial internal organization of case handling and the ignorance of the principle of authority demarcation,there is still a big gap between the current authority list of procurators and the reform anticipation.Grading the rank of prosecutors and classifying the category of procuratorate powers are the basic ways to improve the authority list.From the view of grading,we should reclassify the jurisdiction between higher and lower procuratorates,and optimize the power allocation according to the rank of the prosecutor.From the view of classification,we should encourage the diversity of power operation modes,forming a mechanism with the combination of administrative,judicial and supervisory function,and optimizing the power allocation on its basis.
