台湾地区人口贩运罪及其法律规制研析

摘　　要：台湾地区人口贩运构成要件由基于剥削目的、实行不法手段和处置他人的行为三部分构成。台湾已基本建立以刑法为基础,人口贩运防制法及其施行细则为专法,保护特定人群特别法为补充,较为完善的法律体系。相较而言,台湾防治人口贩运法律规制体系较为缜密,大陆相关立法与司法的理念和实践近年进步显著,但在被害人保护方面,大陆可从法律针对性、政策保障和社会保护等方面借鉴台湾的经验。Human trafficking in Taiwan Region based on the exploitation, illegal means and disposal of others. Taiwan has well established legal system to combat human trafficking crimes effectively and protecting the victim＇s rights and interests. Trafficking prevention legal regulation system of Taiwan is more rigorous, and legislation concerned with judicial philosophy and practice of the Mainland in recent years has significant progress. But in terms of the victim protection,the Mainland should learning from Taiwan experience of targeted legislation, policy support and social protection,etc.
