摘　　要：离婚损害赔偿与婚内损害赔偿尽管只有一字之差,但二者却有很大不同。本文拟从离婚损害赔偿与婚内损害赔偿的法律界定着手,阐述离婚损害赔偿的特征再比较分析二者在构成要件、法律适用、提出赔偿请求时间、法律规定事由范围和权利主体有无过错的不同,从立法层面——明确规定婚内损害赔偿制度、理论层面——允许责任竞合问题存在和在实践层面——扩大离婚损害赔偿的适用范围来讨论离婚损害赔偿与婚内损害赔偿的协调问题,为完善我国夫妻损害赔偿制度提出建议。Even if there is only one word′s difference between divorce damage compensation and martial damage compensation,but there also exists a considerable difference.The essay intended to start from the legal definition of divorce damage compensation and martial damage compensation,briefly stated features of divorce damage compensation and comparatively analyzed difference of both in constructive ingredient,law suitability,compensation requesting time,ranges of legal reasonability and power body to literately regulate system of martial damage compensation on the theoretical and practical aspects to discuss coordination of divorce damage compensation and martial damage compensation and proposed individual viewpoints of improving China′s divorce damage compensation system.
