摘 要:雇员在雇佣的范围之内实施了侵权行为是雇主承担替代责任的前提条件。由此,对雇佣范围进行认定就显得尤为重要。但是认定雇佣范围并不是仅凭一项原则或者某一因素就能确定。具体来说,判定是否属于雇佣范围,首先要看行为是否是发生在雇主所规定的时间和地点内,其次判断是否为了雇主的利益和目的而作为,分析其行为与雇主的生意有无关联性,继而通过对不属于雇佣范围的情况进行分析,从而把握雇佣范围的界限,为雇主承担替代责任寻求依据。Employees who commit infringement within the scope of employment are prerequisites for the employerto assume replacement liability.Therefore, it is particularly important to identify the scope of employment.However,the scope of employment is not determined on the basis ofa single principle or a certain factor.Specifically, todetermine whether it belongs to the scope of employment, it first depends on whether the behavior occurred withinthe time and place specified by the employer. Second, it judges whether it is for the benefit and purpose of theemployer and analyzes whether the behavior is related to the employer's business. Then, through the analysis ofsituations that do not belong to the scope of employment, we can better grasp the boundaries of the scope ofemployment and seek the basis for employers to assume alternative liability.
