小区防空地下室产权与维护管理模式比较分析

摘　　要：由于在平时具有停车等多种用途,加上权责不明,围绕小区防空地下室的收益和维护管理责任一直存在矛盾纠纷,影响了其防空效能。为了寻求一种有效的产权与维护管理模式,以避免各种纠纷,确保其防空效能,通过对全国36个重点城市调查分析发现,目前小区防空地下室的产权和维护管理存在3种模式:产权私有模式、产权未定模式和产权国有模式。以上海、南京、北京作为3种模式的典型代表,沿着产权归属影响和决定维护管理,维护管理影响防空效能的思路进行比较分析发现,产权国有模式相对于其他两种模式,更有利于其防空效能维护。因此,产权国有模式应该作为未来小区防空地下室维护和管理改革的方向。Residential air defense basement combined with civil construction possesses various uses such as parking,but contradictions and disputes around the usual income and maintenance management responsibilities affect the function of the residential air defense basement. In order to ensure its air defense efficiency and to avoid the disputes,the author tends to find an effective mode of property rights and maintenance management. The investigation and analysis are launched among 36 top cities in China,and three modes of property rights and maintenance management in the residential air defense basement are raised： private property rights model, property right undecided mode and the state-owned property model. Based on the idea that the state ownership effects maintain management and maintain management influences air defense effectiveness,taking Shanghai,Nanjing and Beijing as the typical representatives,it is found that the state-owned model is more conducive to the protection of air defense effectiveness. Therefore,the state-owned property mode should be the direction of the maintenance and management reform of the future air defense basement.
