国际条约适用于国内无涉外因素的民事关系探析

摘　　要：国际条约在国内直接适用的范围和程度取决于两大条件:一是主权国家基于利益考量的自主决定;二是条约本身设定的适用范围。国家对每一具体国际条约可否适用于国内无涉外因素的民事关系具有自主选择权,国家决定直接适用国际条约的范围与程度主要取决于对其(国家)自身利益的综合考量,不能一概认为国际条约不能适用于国内无涉外因素的民事关系;司法机关在无涉外因素的民事关系中决定是否适用国际条约时,应当慎重考察国家缔结或者参加国际条约的意图和立法机关的意见。The scope and extent of domestic application of the international treaty lie on the two basic prerequisites： the first is the autonomous decision made by the sovereign state on the basis of benefit considerations; the second is the scope of application defined in the specific international treaty. The sovereign state may take its own discretion as to whether the specific international treaty is applicable to the domestic civil relationship without any foreign element; when the sovereign state intends to determine how to apply the international treaty, the scope and extent of domestic application of the international treaties mainly depend on comprehensive consideration of its own national interests. It is not universally true that all the international treaties are inapplicable to the domestic civil relation without any foreign element. The judiciary authorities shall investigate prudently the opinions of the legislative body and the intents of the state concluding or acceding to the international treaty while considering whether the international treaty applies to the domestic civil relation without any foreign element.
