美国对华“301调查”所涉知识产权问题及其应对

摘　　要：特朗普就任美国第44任总统后,便以重振国内制造业作为执政重纲而采取一系列诡异的内外政策行动,包括宣布退出会谈各方基本达成一致的TPP、退出国际舞台上扮演重要角色的联合国教科文组织,以及启动对华"301调查"。特朗普政府单方面启动本次调查旨在阻挡中国产业升级和制造业发展的进程,并希望以此来遏制竞争对手。然而,此次"301调查"针对中国的知识产权问题显然缺乏事实和法律依据。面对此次调查,我国政府应当利用中国市场的宽度、中华文化的厚度以及WTO贸易争端解决机制的强度以维护中国政府形象和企业利益,同时应当做好反制裁预案以对抗美国的报复行径。从长远来看,我们需要审视我国知识产权制度、市场体制机制以及相关问题,在遵守国际规则的基础上结合我国实际加以完善。The Trump administration has taken a series of quirky measures about internal and external policies in order to revive the domestic manufacturing industry,which is his significant governing guidelines,after Trump became the 44 th president of the United States,such as proclaiming to withdraw from TPP which was basically agreed by all parties,the UNESCO that takes an important role in the International stage,and starting the survey of Section 301 against China. The purpose that the Trump administration started this survey unilaterally is to obstruct the development of Chinese manufacturing industries and the progress of industrial upgrading.However,the questions about intellectual property reflected by this survey of Section 301 against China has a lack of truth and legal evidence. Our country should give play to the width of the Chinese market,the clemency of Chinese culture and the strength of the WTO dispute settlement mechanism to protect our country＇s image and enterprises＇ interests. Meanwhile,we should formulate an Anti sanctions plan to cope with the Trump administration＇s revenge. In the long term,we should rethink the intellectual property regime,the market system and related issues,and optimize them on the basis of following the International rules and the actual situation of China.
