摘 要:《人民警察法》(修订草案稿)在身份查验、盘查的基础上增加了交通工具拦停、人身检查和生物信息采集等具体临检措施。司法实践中,公民对警察实施的盘问、检查等临检行为不服难以获得行政诉讼的救济,临检权性质、执行方式、适用条件不明确导致难以对其进行合法性审查。临检权属行政强制措施,其发动不以具体案件、具体对象为前提,适用程序简单,这是其与刑事侦查的最大区别。警察临检权的适用应遵循法治原则和权力行使适度原则,根据亲自观察或他人提供的信息为基础,结合危害防止与合理怀疑综合判断。Besides identity examination and interrogation, The Law of Police (Revised Draft) added measures for stopping vehicles, physical inspection, biological infomlation collection and so on. In judicial practice, it is difficuh for a citizen to acquire remedies such as administrative proceeding when he is unsatisfied with the policeman's visitation and investigation, moreover, it is difficuh to guarantee the validity of the policeman's investigation because its quality, methods and application condition are unclear. The right of visitation is an administrative coercive measure. The application of such measures is not based on the specific case and object. Its applicable procedure is simple, which distinguishes it from criminal investigation. The application of the policeman' s right of visitation shall obey the principle of rule of law, and moderation of power exercising, based on the information collected through observation or inquisition, and making synthetic judgment by combining precaution and reasonable doubt.
