摘 要:作为医疗纠纷多元化解机制的重要内容,第三方调解以其形式灵活、成本低等优势在全国范围推广,在实施中也显露出较为明显的缺陷。应构建全面、合理的评估指标体系,以对第三方调解的法律绩效提供系统性评价。笔者以平衡记分卡为视角,从第三方调解组织内部流程、员工学习成长、财务以及"顾客"4个维度设计综合调解率、员工流动性、资金筹措能力和医患满意度等具体评价指标,以期全面、客观、真实地掌握医疗纠纷第三方调解的法律绩效,为制度完善提供科学依据。As an important part of the muhiple resolution mechanism of medical disputes, the third party mediation has becK1 popularized throughout the country with its advantages of flexible lorm and low cost. At the same time, the problems exposed in the implementation of the third party mediation are also prominent. Establish a comprehensive and reasonable evaluation index system to provide a systematic evaluation of the le- gal performance of third party mediation. From the perspective of Balanced Scorecard, the specilic evaluation indicators such as comprehensive mediation rate, employee mobility, fund-raising ability and doctor-patient satislhction are designed from lout dimensions of the third party media- tion organization' s internal process, learning and grow th, fiKlancial and c ustomer in order to grasp the legal perlbrmance of the mediation of the third parties in medical disputes entirely, objectively and truthfully, and provide scientilic and ellective basis for the improvement of the system.
