摘 要:目的通过对13例不排除电流损伤死亡案例的回顾性分析,探讨该类案件的法医学鉴定特点,分析鉴定意见的文字表述方式,提示法庭质证注意事项,为同类案件的鉴定和质证提供参考和借鉴。方法回顾分析某中心2009年至2017年13例不排除电流损伤死亡案例。结果 13例案件现场均具备电击条件,但尸体体表皮肤均未检见电流斑,且组织病理学检验均未检见致死性疾病病理改变,排除常见毒药物中毒死亡及其它死因,死亡原因均为不排除电击死亡可能。13例案件委托当事人、办案机关、法院等均对鉴定意见提出质疑。结论无电流斑电流损伤致死是法医学实践中一类特殊的案件,因客观证据缺失导致无法明确鉴定意见。可能性鉴定意见将导致鉴定机构、鉴定人面临投诉、缠鉴、鉴闹、出庭、甚至人身恐吓和威胁的情况。Objective Through retrospective analysis of 13 death cases not excluding causing by electric injury, to discuss the characteristics of forensic identification for this kind of cases, analyzing the textual presentation of identification opinions, prompt court's matters and attentions during cross-examination, to provide a reference for the identification and cross-examination for the similar cases. Methods Retrospectively analyzing 13 death cases not excluding causing by electric injury from 2009 to 2017 of a certain center. Results 13 cases have different situations. Electric shock conditions all exist at the scene in all cases. While no electric mark is detected on the body surface skin. No pathological changes in fatal diseases are detected in internal organs and histopathological examinations. Poisoning deaths and other causes of death are excluded. The possibility of electric death cannot be excluded. In the 13 cases, the identification opinions are all doubted by the parties to the case, case-handling authorities, the court, etc. Conclusion In the cases of electric injury death without electric marks, identification institutions and appraisers may be faced with complaints, entanglements, court appearances, and even physical intimidation and threats.
