贪污受贿案涉案金额的结构性特征——基于司法判决书数据的初步分析

摘　　要：本文聚焦的研究问题是:在腐败市场上,权力是如何定价的?腐败金额反映了贪官在腐败市场上获取利益的能力,同时也反映了行贿者购买权力所要支付的成本,对于理解中国的腐败的现状极为重要。在腐败市场理论的背景下,基于一个全新的司法判决书数据的初步分析,我们发现:腐败类型、腐败案件所在地区、贪官的行政级别和职务、贪官所在部门的管辖领域对腐败案件的涉案金额都有显著影响。这些发现进一步说明,在今天的中国,贪官通过受贿获得的利益要大于贪污;权力的价格随着经济发展水平的提高也在上升,东部经济发达地区的涉案金额要高于中西部经济不发达的地区;权力的价格还取决于其支配资源的大小,因此,贪官的行政级别越高,平均涉案金额也越高;从管辖领域来说,金融和房地产领域的涉案金额最高,其他领域差别不大。The research question focused on in this paper is： In the corrupt market,how is political power priced？ The money value of corruption reflects the ability of corrupt officials to obtain benefits in the corruption market,and also reflects the cost to be paid by bribers to purchase power. It is extremely important to understand the status of corruption in China. Based on a preliminary analysis of a novel judicial judgment data,we found these following factors have significant affect： the type of corruption,the area where corruption occurred,the administrative rank and position of corrupt officials,and the jurisdictional area of the department where the corrupt officials were involved. These findings further illustrate that,in today＇s China,the benefits of corrupt officials through bribery are greater than those of embezzlement. The price of power has risen as the level of economic development has increased. The amount of money involved in the economically developed regions in the east is higher than that in the central and western regions. The price of power also depends on the size of its resources,so the higher the level of corrupt officials,the higher the average amount involved. From the jurisdictional field,the amount of money involved in the financial and real estate areas is the highest,and the other areas are not much different on average.
