新闻舆论监督的法定缘由、内在冲突及完善路径

摘　　要：新闻舆论监督既是社会主义民主政治的重要内容,又是社会主义政治文明进步的重要标志。目前,新闻舆论监督在地位层面、利益层面以及权力界限层面尚存在内在冲突。本文认为,只有平衡新闻自由权与法律公平公正之间的关系以及新闻媒介的独立性与法律体系的自治性之间的关系,才能有效化解冲突,新闻舆论也才能真正发挥法治监督的作用。News supervision by public opinion is not only an important content of socialist democratic politics,but also an important symbol of the progress of socialist political civilization.At present ,there are internal conflicts in the status, interests and power limits of news supervision by public opinion.This paper holds that only by balancing the relationship between freedom of the press and legal fairness and justice,as well as the relationship between the independence of the media and the autonomy of the legal system,can conflicts be effectively resolved,and news media can play a real role in the supervision of the rule of law.
