摘 要:越来越多已达退休年龄的人员再次加入职场,但这部分劳动者因为《劳动合同法》第44条与《劳动合同法实施条例》第21条对关于达到法定退休年龄劳动者的劳动合同的终止规定不一,在劳动权益保护上得不到正常劳动者应有的公平对待。以上规定中关于这部分劳动者与用人单位的劳动关系是否自动终止、终止后用人单位是否需要支付经济补偿、劳动者如果继续工作能否享受工伤保险待遇等问题存在着冲突。从理论入手,结合司法实践,探讨这部分特殊劳动者的权益保护问题。More and more people who have reached retirement age are joining the work force again. However, "Labor contract law" article 44 has different rules on problem about labor contract termination from the "labor contract law implementation regulations" article 21. These rules make it difficult to terminate labour contract automatically and to let the employee pay economic compensation to the employer after the termination of labor relations. It is a problem that the worker after legal age continues to work whether he can enjoy injury insurance treatment.
