民商合一体例下民法典制定的本土化改良

摘　　要：民商合一乃是世界立法趋势,但这样的合一趋势,未必适合我国,不可机械套用。对国际视野下的立法实践进行梳理,分析我国既有立法格局,认为需要结合我国的现行法律制度特点和现实需要,根据中国国情特色,灵活地进行本土化改良,并就民商合一趋势下立法路径的构建提出建议。The combination of civil and commercial laws is the trend of world legislation, but such a trend of unity may not be suitable for China, and it cannot be applied rigidly. Through combing the legislative practice in the international perspective, this paper analyzes the existing legislative pattern of China, and believes that it is necessary to combine the characteristics of China＇s current legal system and the needs of the realities, and flexibly carry out localization and improvement according to the characteristics of China＇s national conditions. The article puts forward two suggestions on the construction of the legislative path under the trend of civil and commercial integration.
