摘　　要：目的探讨安徽芜湖地区刑事责任能力评定案件的特点及一般规律,为精神障碍患者的防控工作及预防违法犯罪行为提供一些参考数据。方法对2013年9月～2016年11月在安徽昌平司法鉴定所实施刑事责任能力评定的案件200例进行资料收集。结果 200例刑事案件中,男性占85%,平均年龄(36.60±13.18)岁,初中及以下文化程度占85%,未婚及离异者占58%,无业及农民占83.5%。作案类型中,涉嫌盗窃所占比例最高,为30.5%,其次为故意伤害(27.0%),故意杀人占9.0%。鉴定诊断前5位依次是情感性精神障碍(28.5%)、精神分裂症(21.5%)、精神发育迟滞(20.0%)、无精神病(13.5%)和器质性精神障碍(5.5%)。鉴定意见为完全刑事责任能力最多,占43.5%,限定刑事责任能力所占比例最少,为26.0%。结论安徽芜湖地区刑事责任能力评定的案件中,以青壮年男性、低文化程度、未婚的无业人员及农民为主。鉴定诊断前5位的是情感性精神障碍、精神分裂症、精神发育迟滞、无精神病和器质性精神障碍。Objective To probe into the characteristics and universal law of criminal responsibility assessment cases in Wuhu of Anhui province,so as to provide some reference data for controlling and prevention of illegal and criminal activities. Methods 200 cases were collected in Changping Judical Authentication Institution of anhui province during september 2013 and november 2016. Result In these 200 cases,males take up 85 percent,whose average age was 36.6 years,junior and secondary educational level were 85 percent,unmarried or divorced were 58 percent,unemployed or farmer were 87.5 percent. Among the types of the crime,theft accounts for 30.5 percent,then intentional injury（27.0 percent）,intentional homicide 9.0 percent. The top five diagnosis as followed ：emotional disorders（28.5 percent）,schizophrenia（21.5 percent）,mental retardation（20.0 percent）,non-psychosis（13.5 percent）and organic mental disorders（5.5 percent）. The majority of expert opinion is full criminal responsibility,which was 43.5 percent,while the minority is limited capacity for criminal responsibility,which was 26.0 percent. Conclusion Male youth,low literacy,spinsterhood,unemployed and farmers give priority to criminal cases in Wuhu area. The top five diagnosis as followed ：emotional disorders,schizophrenia,mental retardation,non-psychosis and organic mental disorders.
