摘　　要：如果发明与现有技术的区别技术特征属于本领域的常规技术手段,如何确定该区别技术特征所达到的技术效果,如何确定实际解决的技术问题进而进行创造性评判?本文基于一个医药领域的具体复审案例,从惯用技术手段实际解决了怎样的技术问题的角度出发,对创造性评判的方法进行了探究。If the difference between invention and existing technology belongs to the conventional technical means in the field, how to determine the technical effect achieved by the differentiated technical characteristics, how to determine the practical technical problems and make creative judgement？ Based on a specific case of reexamination in the field of medicine, this paper explores the method of creative judgement from the perspective of technical problems actually solved by customary technology.
