摘 要:在资本主义晚期,资本主义积累的内在矛盾进一步凸显,合法性危机爆发,因此哈贝马斯试图为合法性找寻新的范式,即用交往行动理论、公共领域和商谈民主等作为理论支撑对合法性进行重建。哈贝马斯对合法性的重建体现了他的批判反思精神,有其蕴含的哲学基础,也可以看到对人民主权的孜孜追求,实现了对传统合法性理论的扬弃与超越,把西方的合法性研究擢升到一个新的理论境界。但他的合法性也有着不可避免的理想主义色彩,其实用性和可能性都有待进一步考察。In the period of late capitalism, the inherent contradiction of the accumulation of capitalism was further highlighted, and the crisis of legitimacy broke out, so Habermas tried to find a new paradigm for legiti-macy, that is, the reconstruction of legitimacy by means of communicative action theory, common field and ne-gotiated democracy. The reconstruction of Habermas’s legitimacy which has its philosophical foundation can re-flect his critical reflection spirit and show the diligent pursuit of people’s sovereignty. It realized the sublation and transcendence of the traditional theory of legitimacy, and promoted the study of the legitimacy of the west to a new theoretical realm. However, his legitimacy is inevitably idealistic, and its practicability and possibility also need further investigation.
