诚信价值观法律化视野下社会信用立法研究

摘　　要：诚信是社会主义核心价值观的重要内容,其不仅存在于观念层面,而且更主要地存在于规范层面。把诚信价值观的要求由道德诚信转化为法律诚信,能确保诚信价值观在现实生活中得到培育和有效践行。在中国,将诚信价值观的法律化具有必然性,首先市场经济的发展需要通过法律诚信建立起来的信任机制;其次中国重建高信任度社会需要诚信法律规范予以保障。诚信价值观的法律化有两种实现途径,制定专门的信用立法是其中的一条重要途径。中国未来的社会信用立法应采用集中立法模式,即由全国人大制定专门的信用信息管理法。信用信息管理法应确立如下主要制度:建立失信行为的认定标准、信用信息采集和披露的负面清单制度、信用信息符合正当目的的使用制度、失信行为的惩戒制度以及信用修复制度。Integrity is an important part of China’s socialist core values, which is not only conceptual, but also, and mainly, normative as well. To convert the demands of good faith values from moral integrity into legal integrity, we have to make sure that integrity values are cultivated and effectively practiced in real life. In China, it is necessary to legalize the requirements of good faith values. Firstly, the development of the market economy calls for trust mechanisms established by legal integrity. Secondly, the reconstruction of high-trust society in China requires the protection of the credit laws and norms. There are two approaches to legalization of credit values, and special credit legislation is one of the most important. China’s future social credit legislation should adopt the centralized legislative model, which means that the National People’s Congress is entitled to formulate special credit information management law. The credit information management law should include the following： specific standards for recognizing faithless behavior, an inventory system for negative credit information collection and disclosure, the right use of negative credit information in line with legitimate purposes, a punishment system and a system of credit repair.
