摘 要:当前我国对民族区域自治法的执行监督已经形成了立法监督、行政监督和司法监督三种基本的法律监督模式。但是,仍然存在宪法对民族区域自治法的监督保障力度不够、执行监督机制难以落实、绩效评估制度亟待实践等问题。因此,应当以推进合宪性审查制度为契机,改进和提高宪法对民族区域自治法的监督保障力度,建立健全民族区域自治法的配套立法机制、争议平衡机制和法律责任机制,探索实践民族区域自治法的绩效评估制度。Currently,there are three basic legal models for the supervision over the execution of the Law on Regional Ethnic Autonomy in our country,including the legislative,the administrative and the judicial supervision. However,there still exist some problems,such as insufficient constitutional supervision over and guarantee for the Law on Regional Ethnic Autonomy,a weak mechanism for administrative supervision and performance assessment,and so on. Thus,it is necessary to guarantee the constitutional supervision over and guarantee for the Law on Regional Ethnic Autonomy through promoting the censorship of its constitutionality,establish and improve the supplementary laws,a workable dispute-settlement mechanism and performance assessment system as well as liability for illegal activities,and establishes an efficient performance evaluation system.
