摘  要:城市化是现代化的必由之路。随之商品房交易市场进入"化库存"时代,住房租赁市场正面临前所未有的发展契机。参照凯梅尼的理论模型,基于市场需求与政策引导,我国"二元化"住房租赁体制正朝着"单一化"住房租赁体制转型。租金管制是保障宪法上公民的住宅社会权的软化方式,出于对市场自由与私法自治的基本尊重,当前租金管制应当保持适当的谦抑性。租金管制政策应当通过《城市房地产管理法》第55条的转介功能,借由"所有权限制"的遁入路径在司法裁判阶段发挥调控效力。Urbanization is an inevitable way to modernization. With commercial housing market enter into the age of de-stocking,housing lease market obtain an unprecedented opportunity. With reference to Theoretical model by Kemeny,based on the market demands and policy guidance,"cost lease"and "profit lease"gradually participate in market competition together,"dualist lease system"is transforming into "unitary lease system " in China. The rent regulation is a soft way of guaranteeing the residential social right in the constitution and it should maintain proper modesty and restraint in consideration of the fundamental respect to market freedom and private autonomy. The rent regulation policy can take effect in the judicial stage with the referral function of the "Urban Real Estate Management Law "article 55 and the applicable way of the "restriction of ownership".
