论地方政府重大行政决策程序的立法进路——以河北省为例

摘　　要：地方政府重大行政决策程序立法是将地方政府重大行政决策的主要环节予以法治化,把灵活多变的行政决策上升为稳定的法律规定的过程。通过对我国17个省份地方政府重大行政决策程序立法的比较考察,提出河北省地方政府重大行政决策程序的立法进路。在立法原则上,应坚持科学决策原则、民主决策原则与依法决策原则;在立法框架和具体内容上,除总则、决策动议、法律责任和附则外,将公众参与、专家论证、风险评估、合法性审查和集体讨论决定分别作为专章予以规定。关键在于界定重大的范围包括重大决策事项范围与主体范围及运用科学的立法技术进行决策程序设计,并且在与中央立法保持一致前提下,充分考虑地方特点,进一步实现立法的精细化。The legislation of the major administrative decision procedure of the local government is the process of taking the main link of the major administrative decisions of the local government to the rule of law, and raising the flexible and changeable administrative decisions into a stable legal provision. By comparing the legislation of the major administrative decision-making procedures of the local governments in 17 provinces in China, the legislative approach of the major administrative decision- making procedures of the local government of Hebei province is put forward. In the legislative principle, we should adhere to the principle of scientific decision, the principle of democratic decision-making and the principle of decision-making by law. In the legislative framework and the specific content, the public participation, the expert argument, the risk assessment, the legitimacy review and the collective discussion will be specified as the special chapter, in addition to the general principles, the decision motion, the legal responsibility and the supplementary provisions. The key is to define the scope of important decisions, the scope of major decisions and the scope of the main body and the use of scientific legislative technology in the design of decision-making procedures. Under the premise of keeping consistent with the central legislation, we should fully consider the local characteristics and further realize the refinement of the legislation.
