中国的北极政策与北极生态环境共同体的构建——以北极环境国际法治为视角

摘　　要：随着北极冰盖的减少,北极重要的战略地位加上国际治理机制的局限性引发政治、经济、文化、安全等领域不稳定性和风险性。人类命运共同体既是利益共同体,又是责任共同体。2018年出版的《中国的北极政策》白皮书界定了北极地理位置、面积和范围,明确了中国参与北极事务的政策主张,提出北极生态环境共同体理念。这为应对北极气候变化、保护北极独特的自然环境和生态系统等涉北极全球性问题提供了价值指引。北极生态环境共同体的构建,需要各国尤其北极八国通过加强北极环境法治的国际协调与合作,善意履行条约义务,共同推动北极国际法治与时俱进。作为北极生态环境共同体利益的重要组成部分,根据相关国际法权利以及作为负责任大国应有的国际责任与担当,中国参与北极事务具有正当性和合法性。今后,中国应将人类命运共同体理念具体落实到北极国际法制的演变进程中,在北极国际法治框架内提倡、践行北极生态环境共同体理念,加强国际经贸合作,平衡自身与北极国家间的外交利益,推动北极生态环境共同体理念的构建与贯彻。With the reduction of the Arctic ice cover,the important strategic position of the Arctic and the limitations of international governance mechanisms have led to instability and risked in the political,economic,cultural,and security fields. The community of shared future for mankind is both a community of interests and of responsibility. The White Paper on China 's Arctic Policy published in 2018 defines the geographical location,area and scope of the Arctic,as well as clarifies China 's policy of participating in the Arctic affairs,and proposes the concept of the Arctic Eco-environment community. This provides value guidance for dealing with Arctic climate change and protecting the Arctic's unique natural environment and ecosystems. The construction of the Arctic Eco-environment community requires countries, especially the eight Arctic countries,to fulfill their treaty obligations in good faith by strengthening the international coordination and cooperation of the rule of law in the Arctic environment,and jointly promote the rule of law in the Arctic International to keep pace with the times. As an important part of the interests of the Arctic Eco-environment community,China's participation in the Arctic affairs is justified and legitimized in accordance with the rights of relevant international law and its international responsibility and responsibility as a responsible big country. In the future,China should implement the concept of the community for shared future of humankind in the process of the evolution of the Arctic international legal system,promote and practice the concept of the Arctic Eco-environment community within the framework of the Arctic international rule of law,strengthen international economic and trade cooperation,and balance the diplomatic interests between itself and the Arctic countries,and promote the construction and implementation of the Arctic Eco-environment Community concept.
