摘  要:随着我国信息通信产业的不断发展,基础电信企业和互联网企业经过运营商霸主、互联网崛起、互联网领跑三个竞争阶段后,二者之间已由传统的上下游关系转变为竞争和合作并存的关系,特别是随着当前互联网企业在信息通信行业内的话语权日益提升,许多互联网企业以"互联网+"等各类服务业务为基础,建立了完整的生态体系,牢牢把控住了用户和市场,业务链不断向低层延伸,对基础企业传统优势领域形成挑战,导致双方在多个层面出现竞争。在这种新形势下,基础电信企业和互联网企业的竞争出现了3类典型问题:一是运营商利用网络技术优势争夺用户资源,二是OTT业务冲击基础电信业务,三是在IT基础设施建设层面低价竞标层出不穷。针对这些问题,建议政府部门主动作为,维护信息通信产业良好的市场环境,从促进行业发展壮大、完善监管制度、创新监管方式、维护行业秩序等4个角度对基础电信企业和互联网企业的竞争进行规制。With the development of China' s information and communication industry, the relationship between telecom companies and Internet companies have gone through three stages, i.e. the leading of telecom companies, the rise of the Internet companies and the leading of the Internet companies, Internet companies are play an increasingly important role in information and communication industry, which leads to the coexisting of cooperation and competition between these two kinds of companies. Under this new situation, there are three typical problems in regulating competition. First, telecom companies take the advantage of network technology to compete for user resources. Two, OTT services impact basic telecommunications services. The three is the unfair competion in the bidding of IT infrastructure. In view of these problems, we suggest that regulators should take the initiative to maintain a good market environment from four aspects: promoting the development of information and communication industry, improving the regulatory system, innovating the regulatory methods, and maintaining the market order.
