摘　　要：发端于西方的社会结构理论,历经长期的实践检验和众多学者的探索争鸣而日趋成熟。鉴于该理论的综合性特点,在研究调解制度时对其范围进行了限定:在动态中具体使用;坚持整体论;突出人的中心地位。一方面是将该理论作为研究路径来使用,其宏观和微观社会结构共同制约着纠纷调解的运行和结果;另一方面是将其作为研究方法来使用,其中系统论的研究方法运用较为广泛。尽管该理论作为一种研究路径和方法并不是包治百病的良药,其运用具有时效性和地域性,但是通过对社会结构理论的研究,既可丰富调解制度的研究路径和方法,又使我们感受到了其独特的学术魅力,推动了该理论在新时期的丰富和发展。Originating from the western society, social structure theory has been increasingly mature through long term practice inspection and the exploration of numerous scholars. In view of the comprehensive characteristics of the theory, it has limited the scope of the theory： to be used in the dynamic; Insist on holism; Highlight the central position of the person. On the one hand, this theory is used as a research path, and its macro and micro social structure are jointly restricting the operation and result of dispute mediation. At the same time, the social structure is used as the research method, and the re search method of system theory is widely ased. Although this theory as a research path and method is not a cure all mcdicine, its use has timeliness and locality, but based on the research of the theory of social structure, can not only enrich the research path and method of mediation system, but also makes us feel its unique academic charm, promotcs the enrichment and development of the theory in the new era.
