德国行政法院制度模式研究及借鉴

摘　　要：德国行政法院制度模式是世界上非常具有代表性的行政法院制度模式之一。通过分析德国行政法院制度模式的特点,结合我国的基本国情,认为德国式的隶属于司法系统且独立于普通法院的行政法院制度值得我国借鉴。在制度的具体设计上,应着重解决设立行政法院制度的法律依据、组织体系和制度保障等问题。The mode of Gemlan administrative court system is one of the most representative modes of the adminis-trative court system in the world. By analyzing the mode characteristics of the Gemlan administrative court system and combining China＇s basic national conditions, this paper holds that the German-style administrative court systern, which is affiliated with the judicial system but independent of ordinary courts, is worthy of our reference. In the course of building this institution, China should focus on solving the problems of legal basis for the establishment of an administrative court system, organizational system, and institutional guarantees etc.
