摘　　要：基于产权理论的分析框架,结合我国农用地利用的特点,在农用地范围界定的基础上分析了农用地集体所有权的"存量"权能和"增量"权能,从"存量"和"增量"占有权、"增量"使用权及其收益权、"增量"处分权及其收益权等方面分析了农用地集体所有权的权能配置,并进一步分析农用地集体所有权、农户承包权和土地经营权之间的协调性关系。据此,从基于注册制构建新型农民集体经济组织、明确农用地集体所有权"增量"权能的法律地位、建立农用地和新增耕地指标交易机制、探索多元化的农户承包地市场化退出机制、建立统一的农用地承包制度等方面构建农用地集体所有权权能配置的制度供给,以为农用地"三权分置"制度的完善提供有益参考。According to the analysis framework of property rights theory and the characteristics of agricultural land use in China,this paper analyzes the ＂ stock＂ and ＂ increment＂ rights of collective ownership of agricultural land on the basis of the definition of the scope of ＂ agricultural land＂. Then,this paper analyzes the redeployment of rights of collective ownership of agricultural land from three aspects as followed： the ＂ stock＂ and ＂ increment ＂ possession rights, ＂ increment ＂ use rights and their income rights, ＂ increment＂ disposal rights and their income rights. Furthermore,the coordination of agricultural land collective ownership,peasant household contract right and land management right is further analyzed. Accordingly,this paper constructs the system supply of redeployment of rights of agricultural land collective ownership：（ 1） constructing a new type of farmer collective economic organization based on the registration system;（ 2） clarifying the legal status of the ＂ incremental＂ rights of collective ownership of agricultural land;（ 3） establishing the trading mechanism of agricultural land and new cultivated land indicators;（ 4） exploring the diversified market exit mechanism of farmer contracted land;（ 5） establishing a unified agricultural land contracting system. The system supply of redeployment of rights of agricultural land collective ownership is expected to provide a useful reference for the next stage of agricultural land ＂ separation of three rights＂ system.
