摘　　要：改革开放40年来,我国非物质文化遗产保护和知识产权事业迅速发展,专利制度以其特有的保护方式,在促进非物质文化遗产保护和传承中发挥了重要作用。通过专利信息分析,总结40年来我国非物质文化遗产保护的专利实践情况,同时对该期间收录的我国非物质文化遗产领域专利文献进行统计分析,并对专利申请、获权与有效状况,专利保护中法律事件发生状况,专利保护重点技术领域和专利保护重点区域四个方面进行分析,得出我国非物质文化遗产专利信息的总体专利布局情况。研究结果表明,改革开放为我国非物质文化遗产的专利保护创造了条件,专利在非物质文化遗产保护中可以发挥重要作用,我国非物质文化遗产的专利保护已形成一定的基础,其作用的发挥具有多样性及地域差异性。Over the past four decades of reform and opening up, China＇s intangible cultural heritage protection and intellectual property rights have developed rapidly. The patent system has played an important role in promoting the protection and inheritance of intangible cultural heritage with its intangible protection. Through patent information analysis, the paper summarizes the practice of China＇s ble cultural heritage protection in the past 40 years, and makes statistical analysis of China＇s patent literature during the same period. Then by analyzing the four aspects of patent application, authorization and effective status, legal event occurrence in patent protection, key technical areas of patent protection and key areas of patent protection, the paper obtains the overall layout of patent information of intangible cultural heritage in China. The situation and the role of the patent system in the protection of intangible cultural heritage have important practical significance for the full play of the role of the intellectual property system to protect intangible cultural heritage. The research results shows： the reform and opening-up has created conditions for patent protection of China＇s intangible cultural heritage, patent has played a pivotal role in intangible cultural heritage protection, China＇s patent protection of intangible cultural heritage has taken shape with its diversified and regional differentiated roles.
