科技与刑事司法互动的系统论观察

摘　　要：刑法的运作与科技系统的运行在现代社会逐渐形成区分,并衍生出自身独立的结构。现有的刑法规范结构与内容在一定程度上与科技演进发生脱节,科技介入刑法运作的方式也产生负面效果。刑事司法中的专家证人制度、刑事鉴定中"事实"与"规范"难以区隔的困境即为显著例证。生活世界的视域决定了两者融合的必要性。通过系统论的考察,引入结构耦合机制与关系性纲要,在一定程度上能够缓解两者间的冲突,弥合两种系统运作上的逻辑差异。The operation of criminal law and that of technological system gradually become different in modern society and develop their own independent structures. The current normative structure and content of the criminal law derail from technological revolution to some extent, and the intervention of technology into the operation of criminal law also generates negative effects. The difficulty in distinguishing the fact and the norm in the expert witness system and criminal identification is an obvious example. The vision of living world determines the necessity of integrating the technology and criminal justice. Through examining the system theory, introducing the structural coupling mechanism and relational program will ease their conflicts and make up their logical differences in systematic operation to some extent. 
