摘 要:要求初任法官入职前具备一定法律工作经验,有助于提升法官整体业务素质。鉴于基层法院案多人少困境,我国现阶段不宜对基层法院初任法官入职前应具备的法律工作经验提出更高要求,不宜延长律师入职基层法院应具备的法律工作年限,以便能尽快充实我国基层法院法官队伍。为丰富基层法院初任法官入职前的法律工作经验,基于审判工作的特殊性,我国应完善现行预备法官培训机制,通过市场化运作、改革培训方式等途径来提升培训效果。Accumulating a certain amount of pre-service legal-work experience is helpful to improve the overall professional quality of judges. In view of the dilemma of a large number of cases versus a small number of judges in local courts, at the present stage in China, it is not appropriate to impose higher requirements on the pre-service legal-work experience and years of working of junior judges in local courts so as to enrich the team of judges for basic-level courts. In order to improve the legal-work experience of junior judges, based on the particularity of judicial work, China should perfect the current training mechanism of preparatory judges and improve the effectiveness of training by means of market operation and reforming training.
