论监察委员会和检察机关职能的协调衔接——以监察体制改革和刑事诉讼法修改为背景

摘　　要：伴随国家监察体制的改革,监察机关取代检察院拥有职务犯罪的调查权,检察院的职能在新时期发生了新变化。原有的刑事诉讼法需要进行修改从而实现与国家监察法的有效衔接。刑事诉讼法的修改势必会对检察机关职能的演变产生积极影响,从而实现国家监察体制改革背景下监察委员会和检察机关职能的衔接与协调运行。Since China launched the refnrm on the national supervision system, supervisory organs have replaced procuratorates in the investigation of duty-related crimes, and the functions of procuratorates are undergoing changes in the new era. For effective convergence with the Supervision Law of the P.R.C, the Criminal Procedure Law of the P.R.C needs to be revised. The revision will inevitably have a positive impact on the evolution of the functions of the procuratorial organs, as well as achieve the convergence and coordination of the functions of the supervisory committee and procuratorial organs in the context of the national supervisinn system reform.
