摘　　要：近年来,随着跨境电子商务的迅速发展,传统的国际贸易模式发生了深刻的变化,国际贸易参与门槛的降低使得中小微企业通过跨境电商平台逐渐获得了平等参与国际贸易的权利。但是跨境电商规则在时间、空间和价格等方面从根本上不同于传统国际贸易规则,客观上需要建立新的贸易合作机制并推动新的贸易规则的形成。文章阐述了传统国际贸易规则和谈判机制指导电商实践的局限性以及e WTP机制引领或协调制定跨境电商贸易规则的可行性,分析了e WTP倡议下引领国际贸易规则的主要诉求,并借鉴传统商业习惯法的形成过程以及现有国际电商规则的内容,初步探索了e WTP机制下跨境电商规则的形成路径,并尝试地探讨了e WTP机制下跨境电商规则的框架性结构相关问题。In recent years, with the rapid development of cross-border e-commerce, the traditional mode of international trade has undergone profound changes. The reduction in the threshold of international trade participation has enabled SMEs to gradually gain equal rights to participate in international trade through the cross-border e-commerce platform.However, cross-border e-commerce rules are fundamentally different from traditional international trade rules in terms of time, space and price. Objectively speaking, new trade cooperation mechanisms need to be established to promote the formation of new trade rules.This paper elaborates the limitations of the guidance of traditional international trade rules and negotiation mechanisms on e-commerce practices and the feasibility of the eWTP mechanism for leading or coordinating the development of cross-border e-commerce trade rules, and analyzes the main appeals of eWTP in the formation of international trade rules.Based on the formation process of traditional commercial customary law and the content of the existing international e-commerce rules, the paper initially explores the formation of cross-border e-commerce rules under the eWTP mechanism and tries to probe into the related issues of the framework of cross-border e-commerce rules under the eWTP mechanism.
