农村土地承包经营权登记模式:混乱与回归

摘　　要：土地承包经营权存在模糊混乱的表征,其登记模式尤为明显。涉及土地承包经营权登记模式的现行各层次规范之间存在着对立与冲突;土地承包经营权确权登记和变更登记中的＂登记＂性质存在逻辑冲突;登记模式复杂多元。现行法语境下之土地承包经营权登记为物权意思模式的解释路径是荒谬的,我国立法对土地承包经营权的设立采纳的＂准意思主义＂模式,其＂意思＂是债权意思。土地承包经营权的登记模式和公示方式已经成为我国农村土地承包制度深度改革的法律障碍,为消除法律规范之间的龃龉,助于尽快落实＂三权分置＂的政策意图,促进土地经营权流转,土地承包经营权的变动应向登记生效模式理性回归。Contracted management rights of rural land appears rather confusing, the registration model is particular ly obvious. There are contradictions and ditterences among the existing norms of the registration rules of land contracting right, also, there is a logical conflict between confimation of registration right and change of registration right in the na- ture of the ＂registration＂ ;the registration mode is complex and diverse. It is absurd to explain the registration mode of land contracting right as intention of property rights in the cunent legal context. Legislation has established the ＂doe- trine of intentionalism＂ in contracted management rights of rural land, and the ＂ intention＂ is intention of creditor＇s rights. The registration mode and publicity method have became the legal obstacle to the deep refom of rural land con- tracting system. In order to eliminate the discord in legal norms, and to implement the ＂division of three rights＂ policy intent as soon as possible and promote the transter of land management rights, the change of land contractual manage right should be rationally return to the ettective mode of registration.
