摘  要:集体劳动争议是我国当前社会转型背景下劳资冲突的一个突出反映,当前呈现出利益争议突出化,组织性、地域性、行业性强且社会影响力较大的特点,而由于我国的社会经济发展正处于矛盾凸显期,对于集体劳动关系保护的法律规范缺失、工会转型滞后等原因,集体劳动争议解决遭受困境。为此,集体劳动争议法律解决机制的路径选择是当前重要课题。应构建起多元化的复合机制,用宏观立法层面的法律调整和协调、治理模式的过渡和转变以及工会转型的推动来促进集体劳动争议的解决。Collective labor dispute is the prominent reflection of the labor disputes under the background of social transiormation in current China,it appears certain characteristics such as interest dispute becomes more obvious,organ- ized, regional and a great sense of industiT and huge social influence. For lacking of legal noms tor the protection of col- lective labor relations and the trade union transtomlation lags behind in such a period that the economic development of our country is in a period of highlighted contradictions, the settlement of collective labor dispute sulter from hardships For this purpose, the path selection of legal settlement mechanism of collective labor dispute is the important topic now The main idea is to build up diversified composite mechanism, by promoting the coordination of law in the aspect of leg- islation, the transition and transformation of governance model and the trade union transfomation to resolve the collec- tive labor dispute.
