解释论视野下的婚内共同财产分割规则

摘　　要：《婚姻法解释（三）》第四条为婚内夫妻共同财产的分割创设了请求权基础。具体适用时须明确待分割共同财产的范围，并着重审查分割是否有损“债权人利益”；在侵害夫妻共同财产利益的场合，行为表现应当局限于法条的文义解释范围，不宜作扩大解释，认定上应回归“严重损害夫妻共同财产利益”的本质；“一方负有法定抚养义务的人”应解释为夫妻一方本人及其父母、子女，“重大疾病”的认定应严格依照医学标准，“相关医疗费用”以合理、必要为限。婚内共同财产分割标准可参照适用离婚共同财产分割的相关规定。Article 4 of the Judicial Interpretation of Marriage Law （III） establishes the basis of the requesting right for the division of the community property. When it is specifically applied, the scope of the community property to be divided must be defined clearly, and the judges should focus on the“ creditor’s interests”; where the community property interests of the couple are infringed, the performance expressions should be limited to the scope of the legal interpretation of the articles of law without extensive interpretation and the determination should return to the essence of“ damaging the community property interests of the couple seriously”; the scope of“ a person who has a statutory obligation to support” should be interpreted as the husband and wife of the spouse and their parents and children, the identification of“ major illness” should be strictly in accordance with medicine standards, and“ related medical expenses” are limited by reasonableness and necessity. The standard for the division of community property in marriage may refer to the relevant provisions on the application of the divorce community property division.
