摘 要:我国《道路交通安全法》第76条对交通事故的无过错责任承担进行了规定,然而关于这种责任分配是否合理依然存在争论。研究结果显示,演化博弈的两种均衡状态与我国道路交通法律的有关规定的发展是一致的:一方面,长期效率优先的城市空间生产模式,导致我国交通事故责任承担的法律规定缺乏对行人的包容性;而另一方面,随着城市道路资源的有限性和机动车数量不断增长的矛盾日益突出,机动车与行人之间关于路权分配理念与责任承担的冲突也愈发剧烈。其中对行人违章的包容性规定,也会鼓励更多违反交通规定的行为和导致更大的社会负外部性。因此,在城市包容性发展的要求下,机动车与行人之间的交通事故赔偿责任承担应该适用无过错责任原则,除提高交强险的责任限额以外,超过责任限额以外的部分,机动车的赔偿责任或可由10%提高至50%。The article 76 of China,s road traffic safety law stipulates the responsibility for thetraffic no fault accident, but there is still controversy about whether the responsibility distribution isreasonable. The result shows that the two equilibrium states of the evolutionary game are consistentwith the development of the legal provisions concerning road traffic in China. On the one hand, thelong-term efficiency-first urban spatial production mode leads to the lack of pedestrian inclusivenessin the legal provisions of liability for traffic accidents in China. On the other hand, with the contra-diction between the limited urban road resources and the increasing number of motor vehicles becom-ing increasingly prominent, the conflict between the concept of road rights distribution and the re-sponsibility of vehicles and pedestrians is increasingly fierce, meanwhile, the inclusive regulationson pedestrian violations also encourage more violations of traffic regulations and lead to greater nega-tive social externalities. Therefore, the liability for compensation in traffic accidents between the mo-tor vehicles and pedestrians should apply the principal of no-fault liability based on the requirementsof urban inclusive development Moreover, in addition to raising the liability limit of strong insur-ance, the liability for compensation for motor vehicles may be increased from 10% to 50% beyondthe part of the liability limit.
