信访立法的价值选择及制度构建

摘　　要：我们应当加快信访立法步伐,信访立法的目标应当是落实公民的宪法权利,统一协调信访,使争议能够协调、有序、分层次解决。信访立法应当坚持以下基本原则:以科学的制度设置来减少越级上访,以刚性的制度规定来落实信访权利,以宽广的视野来重构信访制度,以改革的精神来配置争议解决权力,以宽容的态度来保障信访秩序。在未来的信访法中我们应当确立人大统领、县为基础、行政监察专员等基本制度。We should expedite the legislation of complaint letters and visits, whose aims must include realizing citizens'constitutional rights, coordinating complaint letters and visits and solving disputes coordinately, orderly and reasonably. While in the complaint letters and visits legislation, the following principles should be embodied; reducing the complaint visits which violate procedures with scientific systems; realizing citizens' rights of complaint letters and visits with rigid regulations; reconstructing complaint letters and visits system with broad horizons; collocating dispute-solving power with reformational spirit and safeguarding complaint letters and visits order with tolerant attitude as well. Moreover, this article presents that the intending complaint letters and visits law should establish a complaint letters and visits pattern that being under the Peoples Congress and based on counties, besides that, several basic systems such as succor ombudsman system should be introduced in the law also.
