摘　　要：控制污染转移和领土的无害使用是国家环境权的重要组成部分。为了维护环境安全,一国有权控制污染转移。随着经济全球化发展,各国在实行外资准入过程中逐渐产生了污染转移问题,尤其是发展中国家深受其害。从实践看,外资准入过程中产生的污染转移主要有两种具体形态,即污染产业设立和出资方式中的技术、设备污染转移。我国对这两种污染转移形式尽管在立法上已经有所规定,但是现行法律制度对此问题的调整仍然存在较大缺失。为了有效控制污染转移问题的恶化,我国应该完成对《环境保护法》宗旨性条款的修改,完善相关配套的法律制度,严格三资企业审批制度,强化环境责任的约束力和环境污染损害的救济制度。The control to the pollution transfer and the harmless use of the national territory should be important contents of the national environment right.In order to realize the environment security,a country is authorized to control the pollution transfer. However,along with the development of the economical globalization,various countries gradually were bothered by the problem of pollution transfer in the process of admission the foreign capital,among which the developing countries were damaged deeply in particular. From the aspect of practice,pollution transfer produced in the process of admission the foreign capital mainly have two kinds of concrete forms including that establishing of pollution industries and the transfer of pollution technology and devices in the process of providing the foreign capital.Although China has laid clown some related legal stipulations,many legal loopholes still exists.Therefore,in order to effectively control the aggravation of the problem on pollution transfer,China should complete the revision objectively to'Environmental Protection Law',perfect the protecting environment-related regulations,examine and approve foreign investment enterprises more strictly,and strengthen the binding force of environment responsibility and redress measures to environment damage caused by pollution.
