体育纪律处罚争议解决中的体育协会内部仲裁与外部体育仲裁关系研究

摘　　要：体育纪律处罚具有类刑罚性,体育组织应设置不同的“审级”,如内部仲裁与外部仲裁,解决处罚纠纷。我国大部分体育组织对纪律处罚争议解决的内部仲裁程序未作明确规定,现有规定存在着自设内部程序最高效力、仲裁员不中立、程序过于简单等问题。在我国体育仲裁机构建立的同时,各单项协会的内部仲裁制度应做相应修改,以与体育仲裁制度相衔接。The punishment is a kind of penalty and sports organization should establish different dispute solution level, like internal arbitration and exterior arbitration in punishment dispute solution system.the internal arbitration procedure of discipline dispute solution are not explicitly stipulated in most of sports organization in China, the existing system award the internal procedure maximum potency, non-independent arbitrator, simple procedure. While sports arbitration establishing in China, sports association's internal arbitration system should make the corresponding revision, links up with sports arbitration system.
