摘　　要：《侵权责任法》第八章对环境污染的侵权责任所做的规定,一定程度上,在保护受害人的合法权益、减少环境污染事件的发生等方面体现了立法的先进性,但是在实践的适用中仍存在着问题。该文介绍了《侵权责任法》第八章"环境污染损害"中四个条款的具体规定,并且分析了其在适用中存在的问题,同时提出了自己的意见和建议,以期《侵权责任法》对环境污染侵权的规定在实践中能够得到更好的适用。The regulation of the liability of environment pollution tortus in Chapter Eight of The Tort Law,in some way,has embodied the progress of legislation on the aspects of protection of the victims as well as the reduction of the emergence of environment tortus,while there are still a lot of problems during the application in practice.This passage introduces the specific stipulations of the four clauses in Chapter Eight 'Damages of the environment pollution' and analyzes the problems hereinbefore,then puts forward the writer's opinions and suggestions,expecting to make the regulation about environment tortus of The Tort Law apply well in practice.
