摘　　要：中国农村村民自治经历了由农民自己创造的村民自治到政府推动下的村民自治的历史演变过程,在这一演变过程中,村民自治实践促成了一系列的法律制度创新,国家以立法的形式肯定和推动着村民自治的发展。随着村民自治实践的深入进行,仍然需要进一步扩大村民自治法律制度的创新,加快与村民自治相关的立法工作,使村民自治进入有法可依、有法必依的规范化健康发展的轨道。The autonomy by villagers in rural ares of China has gone through a historical, evolutionary process from the villagers' autonomy created by the peasants themselves to the villagers' autonomy promoted by the government. In the course of this evolution, a series of Innovation of legal system has been done in the villager's autonomy practice, and the development of the villages' autonomy has been affirmed and promotoed in the legislative form by the state. Along with the deepening of the villages' autonomous pratice, the pioneering of the villagers' autonomous pratice, the Innovation of legal system in autonomy by villagers' still needs to be further strengthened, and the legislative work relating to villagers' autonomy should be accelerated so that the villagers' autonomy can be put on the tract of normal, healthy development to ensure that there are laws to abide by, and that the laws are strictly observed.
