摘　　要：从性与婚姻的关系着手,详细论述了婚内强奸的原因,列举了社会上几种关于“婚内是否有奸”的观点。从社会的、道德的、法律的层面来论证,“婚内强奸”虽然具有一定的社会危害性,但不构成一般强奸罪的行为,只是一个道德问题,不应该也不需要法律强制力的介入。在中国现阶段宣判婚内强奸罪,时机还未成熟。From the relationship between sex and marriage,this article deals with the reasons of spousal rape and cites several opinions on spousal rape. From the perspective of society,morality and law , to some extent spousal rape has certain social harmfulness, but it is not a behavior of rape . Spousal rape is a moral issue and the law force needs not to be involved. It is not mature to convict spousal rape at present in China.
