摘　　要：作品的本质是文学、艺术和科学领域内思想的表达。作品不以是非、善恶、优劣为标准,但必须是客观存在的。作品所表达的思想是一个抽象的概念,在现实中主要表现为观念、技术、方法、程序、原则、工艺等内容。作品仅指思想的表达,而不指向被表达的思想。在确定思想和表达的临界点时,尊重作者的观点更具有合理性。思想的表达必须隶属于文学、艺术和科学领域,这意味着作品必须体现某种艺术方法或科学方法。The nature of works is the expression of ideas about literary, art and science. There is no right or wrong, virtuous or evil, good or bad for works. But the works must be objective. As an abstract concept, the ideas are mainly expressed as the concept, technology, method, procedure, principle, process, etc. in reality. All works are only considered to be the expression of ideas but not the ideas themselves. All ideas expressed must belong to literature, art or science, which means that all work must reflect some kinds of artistic or scientific methods.
