农业生态补偿的法律制度探析

摘　　要：农业生态补偿作为生态文明建设的重要环节,已经引起学术界的广泛关注。在本文中,笔者从近些年学术界农业补偿相关问题的研究入手,考虑实施农业生态补偿的必要性因素,进而分析出实施农业生态补偿存在的立法缺乏系统性、制度缺乏可操作性、补偿方式过于单一以及补偿标准不科学等法律问题,并考察美国、日本、欧盟等发达国家的经验,最后从加强农业生态补偿立法的系统性、制定农业生态补偿的具体实施细则、完善农业生态补偿的监督机制给出若干建议。The agricultural ecological compensation, as an important part of the construction of ecological civilization,has aroused widespread concern in academic circles. In this paper, the author studies the agricultural compensation from its related problems in recent years, considering the necessities of the implementation of ecological compensation for agriculture. And then it analyzes some legal problems of agricultural ecological compensation legislation in China, like the lack of systematic legislation and the operational system, single compensation ways and unscientific compensation standard. In the end, through investigating the effects and experiences of the United States, Japan, EU and other developed countries, the author raises some suggestions on the strengthening of the systematic nature of the agricultural ecological compensation legislation, the formulating of the detailed implementation rules of agricultural ecological compensation, and the perfecting of the supervision mechanism of ecological compensation for agriculture.
