城镇化中农民财产权保护的公权力研究

摘　　要：城镇化中农民财产权的保护烙有公权力的痕迹。从历史发展看财产权与公权力相伴而生,经历了财产权的绝对保护和相对限制过程,这一过程中公权力不断扩张,公权力双刃剑的特征更加明显。目前,公权力在我国城镇化过程中对我国农民财产权的保护同样承担重要使命,因此对保护农民财产权的保护必须在厘清公权力与私权利界限基础上,规范公权力主体、内容、程序,保证农民更多财产权利的实现。The protection of farmer's property during the urbanization gains the trace of public power. From historical perspective,the protection of property developed the transformation from defensive to active protection, gradually enlarging in scope, regulation and method. The protection of farmer's property in our country has its own features, within and infringed by the public power. Therefore,the protection should regulate the subjects, contents and procedures of public power, empower more property rights to peasants, and promote the development of urbanization on the base of clarification the limit between public power and private power.
