摘 要:金融危机后,以保护金融消费者为目标的行为监管理念深受各国推崇。而综合经营的市场环境加剧了中国银行业行为监管实施的难度,功能监管比机构监管更有利于银行业行为监管目标的实现。功能监管统一监管标准、鼓励金融创新,有效防治"效力倒置"和"短视立法"等立法技术不成熟问题,与行为监管目标相一致。行为监管是金融监管体制改革的方向,行为监管目标的实现需以功能监管为基础,行为监管与功能监管融合是保障银行业监管体制改革顺利实现的路径。After the Financial Crisis, behavior regulation, which aims at protecting financial consumers, has beenadopted in many countries. And the market environment of integrated business has aggravated the difficulty of theimplementation of the Chinese banking behavior regulation, and functional regulation is more advantageous thaninstitutional regulation in achieving the goal of behavior regulation. Functional regulation unifies regulatory standards,encourages financial innovation, and effectively prevents such immature legislative practices as “effective inversion”and “short-sighted legislation” so as to be in line with the goal of behavior supervision. Behavior regulation is thedirection of the financial regulatory system reform, the implementation of behavior regulation should be based on thefunctional regulation, and the integration of both behavior regulation and functional supervision is the guarantee torealization of the banking regulatory system reform.
