摘　　要：探讨基本权利规范的实质合宪性解释基准,对基本权利的保障在宪法解释实践中起着重要作用——这些基准不仅关涉到基本权利的价值拘束,而且涉及基本权利主体的行为导向和法益保护问题。在基本权利的实质合宪性解释基准上,首先应该适用人性尊严的保护基准。其次,应该适用平等原则的保护基准。最后,应该适用比例原则的保护基准。The exploration of the benchmarks for constitutional interpretation of the substance of basic rights is importantfor the protection of basic rights in the practice of constitutional interpretation as these benchmarks are not only related tothe value constraints of basic rights,but also to the basic right owners' behavior orientation and the protection of their le-gal interests. In the constitutional interpretation of the substance of basic rights,the first benchmark should be the protec-tion of human dignity,the second the protection of the principle of equality,and finally the protection of the principle ofproportionality.
