摘 要:全国首例"斑马线罚款案"中,法院以"连续行为"理论诠释斑马线上的"停步"也属"正在通行"的说法难以服人,真正适合为本案提供理论阐释的应为"过程性行为"而非"连续行为"理论。"连续行为"应为"数个相同行为的反复进行",与涵盖观望、迈步、停步、左顾、右盼、小跑等不同动作的"正在通过人行横道"并不符合。必须认识到相对人行为也可以"过程化",并将"过程性行为"引入《道路交通安全法》第47条,将"正在通行"修改为"通行过程中",并对行人在人行横道上的通行优先权附设"合法通行"的前提条件,将闯红灯通过人行横道和人行横道上非法逗留等情形剔除出法律保护范围之外。The court for the first Zebra Stripe Fine Case nationwide(the'Case')interprets the'STOP'on the zebra stripealso as'Ongoing Pass'based on the Consecutive Behavior Theory, which is far from persuasive.In fact, the Case shall beproperly interpreted based on the Procedural Theory instead of the Consecutive Behavior Theory. The Consecutive BehaviorTheory shall be the repeated process of several identical behaviors, which collides with the Ongoing Pass of zebra stripethat includes such different behaviors as hesitation, stepping forward, stop and wait-and-see. It shall be understood thatthe behavior of administrative counterpart(s) could also be procedural, and it is proposed that the Procedural Behavior be in-troduced to Article 47 of Road Traffic Safety Law of the PRC, namely, amendingthe Ongoing Pass into in the Process ofPass, imposing the precondition of Legal Passage on the preferential rights of pedestrians on the zebra stripe, and removingjaywalk and illegal stop on the zebra stripe out of legal protection.
