摘　　要：在聚合技术条件下,视频聚合平台不再需要将作品上传至服务器即可单独进行对实现著作权人经济利益最为关键的作品展示行为。作品服务器上传者与作品展示者的分离使得继续适用"服务器标准"将出现不合理的结果,并且无法给予著作权人充分的救济。"实质呈现标准"是目前更为合理的标准,视频聚合平台未经许可传播作品的行为应当构成信息网络传播权的直接侵权。Under the condition of aggregation technology, video aggregation platforms no longer need upload works to servers and can display works to the public separately. This makes it possible to continue to apply the“internet server standard”will result in unreasonable results and cannot give full relief to the copyright owner.“Substantial display standard”is a more reasonable standard, and video aggregation platform should be deemed to constitute direct infringement of copyright.
