地方重大行政决策制度的内容分析——基于88个省一级制度文本的研究

摘　　要：决策是政府管理的首要环节。其中,涉及金额较大,相对人较多,对公共利益或社会经济生活影响较为深刻的重大行政决策对社会公众和相关人权利义务有着尤其重要的调节作用,因此有必要将其纳入制度化范围内进行规范。而要规范重大事项决策行为,促进地方重大行政决策体制机制的发展,首先得有成熟的制度文本。采用定量的语义内容分析方法,以预先建立的重大行政决策要素类别为依据,以具有完整内容的句子为最小分析单元,对88个相关的省级地方性法规和规范性文件进行分析后发现:目前我国重大行政决策制度的规范化仍然处于起步阶段,同质化、形式化、简单化情况还时能遇见。具体表现为地方政府重大行政决策的边界范围不清晰、程序设计不完备、公众参与机制不完善以及责任追究不合理四个方面。通过对各地重大行政决策制度文本进行分析可探索出重大行政决策制度的运行实况,发现其存在的问题,为未来政府决策机制的完善提供思路。The decision-making is the key link in government management.The major administrative decision-making in?volving a larger amount of money and more relative person,and influencing public interest or social and economic life moreprofoundly,has a particularly important adjustment role in the public and relevant person’s rights and obligations,forwhich it is necessary to take into account the major administrative decision-making within the scope of institutionalizationto regulate it.However,the first step to regulate the major administrative decision-making behavior and promote the development of the system and mechanism of the major administrative decision-making is to promulgate a set of mature institutional texts.After the analysis of88relevant local laws and regulations as well as normative documents at the provinciallevelby using the analytical method of quantitative semantic content,in the light of the pre-built elements and categories ofthe major administrative decision-making,and with the sentence with full content as the minimum analytical unit,it couldbe found that at present the normalization of China’s institution of the major administrative decision-making is still in theinitial stage,with the occasional occurrence of the homogenized,formalized and even simplified situation,which is manifested specifically in four aspects,which are:the unclearness of the boundary of the major administrative decision-making inlocal government,the imperfecness of the programming,the imperfection of the public participation mechanism and the unreasonability of responsible accountability.According to the analysis of the institutional texts of major administrative decision-making in various regions,we can track out the practical operating conditions of the institution of the major administra?tive decision-making and find out its existing problems,in order to provide a train of thought for the government decisionmakingmechanism in the future.
